McElroy Investments, LLC (“McElroy Investments,” “we,” “us,” or “our”) is committed to protecting the privacy of our borrowers and portal users. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you access our loan servicing portal or communicate with us.

By using our portal or services, you agree to the terms described in this Privacy Policy. If you do not agree, please discontinue use of our services and contact us directly.

Information We Collect

We collect information you provide directly and information generated through your use of the portal:

• Account Information: Name, email address, mailing address, phone number, and login credentials.
• Loan & Financial Information: Loan balance, payment history, account activity, and transaction records associated with your loan account.
• Payment Information: Credit or debit card details submitted at the time of payment. Card data is processed securely through Stripe and is not stored on our servers.
• Communications: Records of correspondence, support requests, or inquiries you send to us.
• Usage Data: IP address, browser type, pages visited within the portal, and access timestamps collected automatically for security and operational purposes.

How We Use Your Information

We use the information we collect for the following purposes:

• To service and administer your loan account, including processing payments and applying adjustments.
• To provide access to your loan statements, amortization schedules, and payoff calculations through the portal.
• To communicate with you regarding your account, including payment confirmations and notices.
• To maintain the security and integrity of our portal and prevent fraudulent activity.
• To comply with applicable legal and regulatory obligations.
• To respond to your inquiries and provide customer support.

Sharing & Disclosure

We do not sell, rent, or trade your personal information. We may share your information only in the following limited circumstances:

• Service Providers: Third-party vendors who assist in operating our portal and processing payments (e.g., Stripe for payment processing, SiteGround for hosting). These parties are contractually bound to protect your data.
• Legal Requirements: When disclosure is required by law, court order, or governmental authority.
• Protection of Rights: When necessary to protect the rights, property, or safety of McElroy Investments, our borrowers, or others.
• Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction, with appropriate notice provided.

Data Security

We implement reasonable administrative, technical, and physical security measures to protect your information from unauthorized access, disclosure, or misuse. Payment data is transmitted via SSL/TLS encryption and processed through Stripe’s PCI-compliant infrastructure — we do not store full card numbers on our systems.

While we take data security seriously, no method of transmission over the internet is completely secure. We encourage you to use a strong, unique password and to log out of the portal after each session.

Your Rights

You have the right to:

• Access and review the personal information we hold about you.
• Request correction of inaccurate or incomplete information.
• Request deletion of your account data, subject to legal and contractual retention requirements.
• Opt out of any non-essential communications.

Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the McElroy Investments borrower portal (“Portal”), operated by McElroy Investments, LLC. By accessing the Portal, you agree to be bound by these Terms. If you do not agree, you may not use the Portal.

These Terms do not modify or supersede the terms of your individual loan agreement. In the event of any conflict between these Terms and your loan agreement, your loan agreement controls.

Portal Access

Access to the Portal is granted to authorized borrowers with an active loan account. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized access or suspected security breach.

McElroy Investments reserves the right to suspend or terminate Portal access at any time, with or without notice, for any reason including suspected misuse or security concerns.

Payments

The Portal allows you to make loan payments electronically. By submitting a payment, you authorize McElroy Investments and its payment processor (Stripe) to charge the provided payment method for the amount specified.

• Payments are applied to your loan balance according to the terms of your loan agreement.
• You are responsible for ensuring sufficient funds or available credit at the time of payment submission.
• Payment confirmations are provided by email and recorded in your Portal account history.
• All payment records displayed in the Portal are for informational purposes and do not constitute a final account statement unless confirmed in writing by McElroy Investments.

Acceptable Use

You agree to use the Portal only for its intended purpose — managing your loan account. You may not:

• Attempt to gain unauthorized access to other accounts or any portion of the Portal’s infrastructure.
• Introduce malware, viruses, or malicious code.
• Use automated tools to scrape, harvest, or systematically access Portal data.
• Impersonate another borrower or any employee of McElroy Investments.
• Use the Portal for any purpose that violates applicable law.

Limitation of Liability

The Portal and its contents are provided on an “as is” and “as available” basis. McElroy Investments makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the Portal.

To the fullest extent permitted by applicable law, McElroy Investments shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Portal, including but not limited to loss of data, unauthorized access, or system downtime.

Our total liability to you for any claim arising from your use of the Portal shall not exceed the amount of your most recent loan payment.

Termination

These Terms remain in effect for as long as you maintain an active loan account with McElroy Investments. Upon full repayment or payoff of your loan, your Portal access may be deactivated. McElroy Investments reserves the right to modify, suspend, or discontinue the Portal at any time without liability.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Tarrant County, Texas.
